Attempt to counter democracy

Quote from a 1965 opinion from the Second Circuit Court of Appeals (with jurisdiction over New York, Vermont, and Connecticut):  “It is beyond dispute that a secret election is a more accurate reflection of the employees’ true desires than a check of authorization cards collected at the behest of a union organizer.”

Quote from a 2007 Senate Bill co-sponsored by Mary Landrieu:  “If the [National Labor Relations] Board finds that a majority of the employees in a unit appropriate for bargaining has signed valid authorizations [cards] designator the individual or labor organization specified in the petition as their bargaining representative . . . the Board shall not direct an election but shall certify the individual or labor organization as their representative.”

This slap in the face to the system of checks-and-balances is brought to you by the Congressional Democrats sponsoring the “Employee Free Choice Act.”

Found another interesting quote..

“It would be difficult to imagine a more unreliable method of ascertaining the real wishes of employees than a “Card check,” unless it were an employer’s request for an open show of hands.” (card check is another name for the EFCA)

That’s from an opinion of a Fourth Circuit Court of Appeals judge’s opinion. 

I guess a lot of a the Senators just really don’t care.  They can probably get any law they want passed, and the judicial system can’t really do much about it.
